The proposed development is situated within 3.5 metres of the River Camac at its closest point, significantly encroaching into this riparian corridor, and it has not been demonstrated how the integrity of the riparian corridor can be maintained and enhanced having regard to flood risk management, biodiversity, ecosystem service provision, water quality and hydromorphology. Permitting development within this 10 metre buffer zone would compromise the ecological integrity of the riparian habitat, risk negative impacts on local biodiversity, and conflict with established Council policies governing the preservation of natural watercourses. Consequently, the proposed development is contrary to the proper planning and sustainable development of the area.
  2. AA and EIA Having regard to the nature and location of the proposal development, its proximity to the River Camac, which is a potential hydrological connection to Nature 2000 sites, and based on the level of information submitted which does not included screening nor a full environmental impact assessment nor appropriate assessment, the likelihood of significant effects on the environment and on Natura 2000 that may arise from the proposed development on its own or in combination with other developments cannot be ruled out at this stage.   3.   1. The proposed development, having regard to levels and contours requiring significant excavation, which has resulted in a poorly designed stepped retaining wall, creating a substandard transition between the existing development to the west of the site and the proposed development in the form of large stepped retaining wall, and where a suitable design solution has not been achieved to minimise the impact on the scheme layout and its main area of public open space, and the substandard design of the dwellings and maisonette units, the proposed development would be contrary to Kildare County Development Plan 2023-2029 objective UD 01 which requires ‘a high standard of urban design to be integrated into the design and layout of all new development and ensure compliance with the principles of healthy placemaking”. Furthermore, in the absence of a coherent and rational approach to key indicators of quality design and placemaking, the proposal would be contrary to the principles of the Section 28 Ministerial Guidelines on Sustainable Residential Development in Urban Areas and the Compact Settlements Guidelines (2024) therefore would be contrary to the proper planning and sustainable development of the area.
  2. The application site is in close proximity to the Royal Canal, a proposed Natural Heritage Area, the proposed development requires significant excavation where the substantial presence of an invasive species (Japanese Knotweed) has been identified and where an Invasive Species Management Plan [in order to comply with the provisions of the European Communities (Birds and Natural Habitats) Regulations 2011-2015 requiring explicit biosecurity measures, chosen treatment methods, and licensed disposal pathways] has not accompanied the application. It has not been demonstrated to the satisfaction of the Planning Authority that the proposed development will not result in significant environmental degradation and the proliferation of a harmful invasive species. The proposed development is therefore contrary to Objective BI 058 of the Kildare County Development Plan 2023-2029 and would be contrary to the proper planning and sustainable development of the area.
  3. Kildare County Development Plan 2023-2029 (as varied) objective TMO 117 seeks to ensure there is appropriate EV charging facilities for residential developments; objective TM O124 seeks to provide sufficient public lighting; objective TM O20 seeks to ensue appropriate permeability through developments and policy TM P7 seeks to ensure that the safety and capacity of the local road network is maintained. Having regard to the substandard provision of EV charging facilities, the lack of public lighting provided on Connaught Street, no permeability from the site to The Crescent, Ledwill Park, and the poor alignment and insufficient road widening on Connaught Street it is considered the proposed development contravenes objectives TM O 117, TM O124, TM O20 and policy TM P7 of the Kildare County Development Plan 2023-2029, would constitute a substandard form of development and would be contrary to the proper planning and sustainable development of the area.
  4. Insufficient information has been submitted with regard to inter alia, cross-sectional drawings, contiguous drawings, and the disposal of excavation material where there is a known invasive species on site to enable the Planning Authority to adequately assess the impact of the proposed development on surrounding residential amenity, the character of the area and the environment. Therefore, it is considered that if permitted as proposed, the development would interfere with the safety and free flow of traffic on the public road and would endanger public safety by reason of traffic hazard, obstruction of road users, or otherwise, and therefore would be contrary to the proper planning and sustainable development of the area.
  2. The proposed development is located directly off the N84 national secondary road and within the GCTPS area, where consideration is given to the need of farm families to live on the family holding on a limited basis and to the functional need to live at this location. In this instance, based on the information submitted, it is considered the applicant has failed to satisfy the housing need requirements set out in policy objectives RH 2 and RH15 of the Galway County Development Plan 2022-2028. Accordingly, to grant approval for the proposed development would contravene policy objectives RH2 & RH15 and DM Standard 26 of the current County Development Plan, would endanger public safety by reason of traffic hazard, obstruction of road users or otherwise on a strategic restricted route and would thus be contrary the proper planning and sustainable development of the area. 2

Also, the proposed development, by reason of the confined site configuration and deficient site layout design, poor quality of architectural design and private open space provision for the proposed residential units, would constitute a substandard quality of residential design and layout, which would be seriously injurious to the residential amenities of prospective occupants and to the character of place at this location. Therefore, if permitted as proposed, it would detract from the visual and general amenity of the prevailing environs and would materially contravene the policy objectives and development management standards of the current county development plan and would therefore be contrary to the proper planning and sustainable development of the area.
  3. In the absence of sufficient information on the traffic management on site, it is considered that the proposed development would seriously infringe on visibility lines required in connection with the proposed parking spaces which are accessed from the existing carriageway serving the residential estate and which, consequently, would generate potential traffic hazards within the estate grounds. It is therefore considered that the proposed development would interfere with the safety and free flow of traffic and endanger public safety by reason of traffic hazard, obstruction of road users or otherwise and therefore would be contrary to the proper planning and sustainable development of the area.
  4. Noting that the landscaping plan provided does not reflect the site layout and design of the proposed development, it is considered that the application as submitted offers no information as to the extent and intended finishes of the external spaces for the proposed development, nor satisfactory details as to their intended landscape treatment, with regard to proposed planting and/or retention of existing mature vegetation on site. To grant permission to the proposed development would materially contravene DM Standards 2, 11 and 47 of Galway County Development Plan 2022-2028 and would therefore be contrary to the proper planning and sustainable development of the area. 2
