What this record establishes

Only exact linked records appear here. A missing appeal, commencement or completion entry means that evidence has not been established on this page. It does not prove that the event never happened.

Planning scale and individual notice or phase quantities remain separate. Notice quantities are not added into a development total or completion percentage.

Complete formal refusal grounds · 2 grounds · 2026-04-08

The council’s formal grounds for this decision. Planner assessment and later appeal outcomes are separate.

  1. Having regard to the Cork County Development Plan 2022, and the Planning Design Standards for Apartments Guidelines for Planning Authorities July, 2025, it is considered that the proposed change of use of the first and second floor levels of The Old Market Bar in Bandon Town Centre, as a form of shared accommodation or co-living development, would fail to provide a satisfactory standard of residential amenity, would constitute a substandard form of development, would seriously injure the amenities of future occupants of the proposed development and would set an undesirable precedent for future development in Bandon town and towns elsewhere within County Cork. Furthermore, the proposed development would be contrary to Specific Planning Policy Requirement 7 of the Planning Design Standards for Apartments Guidelines for Planning Authorities 2025 which states that there shall be a presumption against granting planning permission for shared accommodation / co-living development unless the proposed development is required to meet a specific demand identified by a planning authority further to a Housing Need and Demand Assessment (HNDA) process. No such need was identified in the Cork County Development Plan 2022. Accordingly, the proposed development would, therefore, be contrary to the proper planning and sustainable development of the area.

  2. Having regard to lack of living, cooking, dining, amenity space and storage areas, and the sub-standard natural daylight/ventilation proposed to second floor bedrooms, it is considered that the proposed development would not provide an acceptable standard of residential amenity for future residents, would give rise to substandard development, and would create an undesirable precedent for similar future development. Accordingly, the proposed development would seriously injure the residential amenities of future occupiers, would fail to provide an adequate standard of development for future occupiers and would, therefore, be contrary to the proper planning and sustainable development of the area.
