The council’s formal grounds for this decision. Planner assessment and later appeal outcomes are separate.

  1. The subdivision of the existing site and continued use of the 2 no. existing dwellings on site as separate/independent residential units would result in the material contravention of condition no. 2 of Reg. Ref. F08A/1067 (PL06F.231677), which requires the use of the cottage to be restricted to an ancillary residential use directly associated with the use of the existing house on the site, and the cottage to not be sub-divided from the site either by way of sale or letting or otherwise. The proposed development, if permitted, would be contrary to the proper planning and sustainable development of the surrounding area and would set an undesirable precedent for similar development in the surrounding area.

Therefore, the proposed development would be contrary to Objective DMSO118 - Road Safety Measures of the Fingal Development Plan 2023-2029 and would be contrary to the proper planning and sustainable development of the surrounding area.
