Nocsy 5 Limited intend to apply for permission for development of lands (c. 4.38 Ha) at St Margarets Road (R122), and within the townland of Balseskin, Dublin 11. The main development site is generally bound: to the north by greenfield lands and Dublin Inland Port; to the east by St Margarets Road (R122); to the south by the Balseskin Reception Centre (D11 FX93); and to the west by undeveloped lands. The development will comprise the provision of a warehouse with ancillary offices and staff facilities. The warehouse will have a maximum height of 18.75 metres and a total gross floor area of 16,332 sq m, including a warehouse area (15,154 sq m) and ancillary offices and staff facilities (1,178 sq m).   1. The Planning Authority is not satisfied, based on the information submitted, that the development will not adversely affect the operation and safety of the Regional Road Network (R122). The development will therefore be contrary to Objectives DMSO115 and CMO40 of the Fingal Development Plan 2023–2029. The development, by itself or by the precedent which the grant of permission for it would set for other relevant development, will adversely affect the use of a major road by traffic. The development is therefore contrary to the proper planning and sustainable development of the area.
  2. The subject site is zoned 'GE' General Employment with the objective to 'provide opportunities for general enterprise and employment'. The supporting vision for the 'GE' General Employment zoning objective seeks to 'facilitate opportunities for compatible industry and general employment uses including appropriate sustainable employment and enterprise uses, logistics and warehousing activity in a good quality physical environment. General Employment areas should be highly accessible, well designed, permeable, and legibl' within the Fingal Development Plan 2023-2029. The warehouse development, by virtue of its excessive height and scale is visually domineering and monolithic within the receiving environment and the cumulative arrangement of the HGV dock leveller doors and the HGV yard to the north of the site will seriously injure the visual amenities of the surrounding area. It is therefore considered that the proposed development materially contravenes the 'GE' General Employment zoning objective of the Fingal Development Plan 2023-2029, and would be contrary to Section 14.15.1, Table 14.15, Objective DMSO89 and Policy EEP2 of the Fingal Development Plan 2023 – 2029 in respect of design in industrial areas, setting an undesirable precedent for other similar development. The development would therefore be contrary to the proper planning and sustainable development of the area.
  3. The Planning Authority is not satisfied, based on the information submitted, that the development will not adversely affect the conservation and preservation of a European Site and is contrary to Objective DMSO145 of the Fingal Development Plan 2023-2029 and therefore contrary to the proper planning and sustainable development of the area

Based on the information submitted with the application and the planning history on site, the applicant has not demonstrated to the satisfaction of the Planning Authority that they have a genuine rural generated housing need. The applicant has provided insufficient information to demonstrate that they are in full compliance with Objective SPQHO92 or SPQHO93 of the current Development Plan and that they are not the owner of the adjacent property at Padre Pio, 25 Channel Road as detailed in previous applications on site.   1. 1. The proposed design of 32. Studio units is considered to be substandard and not in accordance with the minimum requirements of the Design Standards for Apartments, Guidelines for Planning Authorities (2025), Department of Housing, Local Government and Heritage. The proposal if approved would result in an unacceptable poor level of amenity and facilities afforded to future occupiers of the scheme by way of layout and design.   2. 2.   3. 3. Having regard to the nature of the proposed development, accommodating retired members of religious orders and persons aged 55 and older, it is considered that the lack of on-site car parking spaces or accessible parking space for the proposed development would be seriously deficient and would be inadequate to cater for the parking demand generated. The proposed development would, therefore, be prejudicial to public safety by reason of traffic hazard on the public roads in the vicinity and would not comply with car parking requirements, as set out in the Dublin City Development Plan 2022 – 2028
  4. 4. The proposed development is reliant on upgrades to the public road on Haddington Place (minor) to facilitate safe pedestrian access, which are outside of the application site boundary. The proposed development, would, therefore endanger public safety by reason of traffic hazard as it has not been demonstrated that safe pedestrian access to the proposed development will be provided and therefore be contrary to Section 2.1 of Appendix 5 of the Dublin City Development Plan 2022-2028, which seek to maximise pedestrian permeability within developments and improve pedestrian and cycle connections to the wider road network, where possible

As such, the proposal would not provide a safe, accessible or attractive arrival point to the development and would be contrary to Objective UD17 of the Park West-Cherry Orchard Local Area Plan 2019 and the safe and secure design principles contained in Sections 15.4.5 and 15.9.11 of the Dublin City Development Plan 2022-2028. The proposed development would therefore be contrary to the proper planning and sustainable development of the area

The proposed amended development would result in a poor standard of residential accommodation by reason of inadequate levels of sunlight to the proposed units, with only one of the three units complying with the recommended sunlight standards for living rooms on the test day. In addition, the proximity and relationship of the proposed public access ramp and stepped access area to the associated private amenity spaces would significantly compromise the functionality, privacy and amenity value of these spaces. The proposal would therefore fail to provide a satisfactory residential environment and would be contrary to Section 15.9.16.1, Appendix 16 and the policies and objectives of the Dublin City Development Plan 2022-2028 and would be contrary to the proper planning and sustainable development of the area.

The development would therefore, unjustifiably increase pressure on the local road network, would lead to demands for the uneconomic provision of public infrastructure and services in an unsustainable manner and would constitute an undesirable precedent for further similar development in the vicinity. The proposal would therefore materially contravene the South Dublin County Development Plan 2022 - 2028, would be contrary to national and regional planning policy objectives and would be contrary to the proper planning and sustainable development of the area.
  2. Having regard to the location of the site on an elevated and exposed position in the sensitive landscape area of the Dublin Mountains and the absence of regard for existing site features and contours, it is considered that the development has not been designed and sited to minimise impact on the character and visual amenities of the surrounding landscape and does not comply with County Development Plan policy relating to rural housing and extension design. The proposed development would therefore, by itself and cumulatively with the precedent it would set for similar development, negatively impact on this sensitive landscape and the natural beauty of the rural area by contributing to the incremental erosion of its character and would contravene Policy H23 and H23 Objective 1 of the South Dublin County Development Plan 2022 - 2028. The proposal is therefore contrary to the proper planning and sustainable development of the area.

I have had regard to the application before me and the recommendation above, and while I concur with the bulk of the analysis, I disagree with the conclusions regarding the acceptability of the residential density that would result from the proposed development. 31 dwellings per hectare falls far short of the 50-250dph minimum envisaged by the Compact Settlement Guidelines. Without prejudice to any future planning application, which would be assessed on its merits, I consider that a site of this size and configuration could accommodate at minimum two own-door houses. On the basis of the above considerations, I decide to refuse permission under the terms of Section 34(10)(b) of the Planning and Development Act 2000 (as amended) for the reason set out below. 1. Having regard to the location of the site within an established urban area served by high quality public transport, and to the provisions of the Dún Laoghaire-Rathdown County Development Plan and national policy guidelines on sustainable residential development, which seek to ensure the efficient use of land and higher densities at appropriate locations, it is considered that the proposed development of a single detached dwelling on this site represents an inefficient and sub-optimal use of well-serviced residential land. The proposed low density would fail to contribute adequately to housing supply, would be contrary to the ministerial guidelines for planning authorities on sustainable residential development in urban areas, and would set an undesirable precedent for similar under-development of serviced urban sites. Specifically, the proposed development would be contrary to Policy Objective PHP18, which is to increase housing supply and promote compact urban growth. Therefore, the proposed development would be contrary to the proper planning and sustainable development of the area.

The proposed development would result in the creation of a substandard vehicular entrance and would facilitate hazardous manoeuvring along the footpath. The third storey/attic-level rear extension would also result in an unacceptable loss of privacy to the building No. 15 Albert Court East, and an overbearing impact to the adjoining properties. This element would create an undesirable precedent for similar type development and would be contrary to Sections 1.1, 1.2 and 5 of Appendix 18 of the Dublin City Development Plan 2022-2028; the Z2 zoning objectives for the site, and the proper planning and sustainable development of the area.

The proposal would be contrary to the policies and objectives of the current Dublin City Development Plan and the proper planning and sustainable development of the area

Having regard to the layout of the proposal, the proximity to existing commercial and residential uses and potential interactions, it is considered that the documentation submitted with the application lacks sufficient details such that the Planning Authority cannot be assured that the proposed backland residential development will not unduly affect the residential amenity of both existing neighbouring occupants and proposed occupants on site nor would represent a case of overdevelopment on a restricted site and would set an undesirable precedent for oversized infill developments. The proposed development would seriously injure the residential amenities of future residents, and would, therefore, be contrary to the proper planning and sustainable development of the area

It is considered that the documentation submitted with the application lacks sufficient details such that the Transport & Drainage Divisions cannot be assured that the proposed development would comply with the Development Plans cycle parking requirements and also not be at risk of flooding. Therefore, the proposed development is considered contrary to the proper planning and sustainable development of the area
