What was proposed

for recovery and recycling of construction and demolition materials within a portion of an extant quarry in a site area of circa 1.5 ha. Upon the grant of planning, a separate Waste Facility Permit will be sought from Cavan County Council and an End of Waste Declaration will be submitted to the EPA for this activity. Planning is sought for six years and will include use of existing plant and machinery and all ancillary site works and services

Refusal reasons
  1. Having regard to the absence of sufficient detail in the planning application drawings and particulars relating to proposed site infrastructure, processing and facilities for a proposed development of this nature including measures for ground and surface water protection and monitoring to prevent hazardous material from entering the environment; to the absence of a baseline ecological report of the site to adequately describe the receiving environment and to assess potential ecological impacts; to the absence of sufficient information to assess the impacts of operational noise, dust emissions, and traffic generation on existing amenities of the area which includes a number of third party dwellings in close proximity to the site; and to the absence of an appropriate level of assessment of the potential environmental impacts of the proposed development in combination with existing permitted development in the wider quarry site, it is considered that the proposed development would, therefore, be contrary to Objectives GW01, GW04, GW06, WQG03, NHDS1, NH8 and IN4 of the Cavan County Development Plan 2022 – 2028 and to the proper planning and sustainable development of the area.
  2. The Planning Authority is not fully satisfied that the proposed development, assessed on its own or in combination with other plans or projects, would not be likely to have a significant impact on a designated European Site having regard to the probability of surface water from the site entering the Erne River which is a hydrological connection to Lough Oughter and Associated Loughs SAC and Lough Oughter Complex SPA. The proposed development is, therefore, considered contrary to Objectives NHDS1, and NH1 of the Cavan County Development Plan 2022 – 2028 and therefore to the proper planning and sustainable development of the area.
