RETENTION & PERMISSION: (1) THE RETENTION OF THE PREVIOUSLY UNATHORISED SINGLE STOREY STRUCTURE CURRENTLY SUBDIVIDED INTO THREE STUDIO APARTMENTS INCLUDING 4NO. ROOFLIGHTS. AND (2) THE MATERIAL ALTERATIONS TO CREATE A 1BEDROOM UNIT, INCLUDING THE CONSTRUCTION OF INTERNAL PARTITIONS AND FORMING 2NO. - The proposed retention of the existing structure and development of a residential unit to the rear of a residential property of this design and extent in such close proximity to the existing house is seriously injurious to the setting of the existing house and the Z2 conservation area, in contravention of Policy BHA9 of Section 11.5.3 of the Dublin City Development Plan 2022-28. Therefore, the proposed development is considered contrary to the proper planning and sustainable development of the area
- 2. The applicant has not demonstrated to the satisfaction of the planning authority that the proposed retention of the existing structure and development of a residential unit therein to the rear of a residential property of this design and extent in such close proximity to the existing house that residential amenity to the parent dwelling would not be unduly affected, having regard to impacts upon privacy, overbearing impacts and impacts on daylight and sunlight. As such that the Planning Authority cannot be assured that proposed development would therefore not be seriously injurious to the residential amenities of the parent dwelling and its occupants. Therefore, the proposed development is considered contrary to the proper planning and sustainable development of the area.
- 3. No evidence is provided that the proposed 1-bedroom unit or that existing dwelling would both be provided with sufficient usable private open space contrary to the requirements of the 2024 Compact Settlement Guidelines. Also, insufficient evidence has been provided that the combined development and occupational levels on site would be adequately serviced in terms of on-site bicycle and refuse storage. As such that the Planning Authority cannot be assured that the proposed development would therefore not be seriously injurious to the residential amenities of the parent dwelling and its occupants and proposed residential unit, and also not constitute overdevelopment of a restricted site. The proposed development would therefore be seriously injurious to the residential amenities of the area and contrary to the proper planning and sustainable development of the area
