9 Saddler's Place, Lusk, Co. Dublin, K45 YX25

Fingal County Council · F26A/0451E

What was proposed

The development consists & will consist of: Retention Permission: 1. The retention of 7.2 sqm area to west side of garage differing from the garage footprint approved under Planning Application F06B/0617, and Planning Permission: 2. The reconfiguration of the garage roof to provide an additional utility room & bedroom in the current garage. The roof will be increased in height with 2 no. rooflights added to the south side of the roof (facing the roadway), 3. The construction of a dormer extension to the rear of the house to provide an enlarged home office & laundry room. Additional Information Received 12/09/206

Refusal reason

The proposed development by reason of its excessive bulk, scale and design would dominate the rear elevation of the subject property. The proposed development would directly conflict with Section 14.10.2.5 (Attic Conversions and Dormer Extensions), policy SPQHP41 and objective SPQHO45 of the Fingal Development Plan 2023-2029; would contravene the ‘RS’ Residential zoning objective for the area which seeks to protect and improve existing residential amenities; and, would set an hugely undesirable precedent for other development(s) of a similar nature. The proposed development would therefore be contrary to the proper planning and sustainable development of the area.

Cork County Council · 26/1626

What was proposed

Permission to construct dwelling, detached domestic garage & all associated

Refusal reason

The proposed development would be prejudicial to public health because the excessive gradient and steep topography of the site render the terrain unsuitable for the safe installation and operation of an on-site wastewater treatment system. The proposal fails to demonstrate compliance with the minimum standards set out in the EPA Code of Practice: Domestic Waste Water Treatment Systems (Population Equivalent $5 10) (2021). The planning authority is, therefore, not satisfied that the development would not give rise to effluent breakout, hydraulic failure, and the subsequent creation of an environmental and public health hazard.

Deerpark Heights, Rathgoggan North, Charleville, Co.Cork

Cork County Council · 25/6124

What was proposed

Permission for dwelling house, entrance, boundary walls, connections to foul and storm and all assocaited works

Refusal reason

The proposed development comprises the construction of a dwelling within a housing scheme on the north eastern side of Charleville town. On the basis of the available information and given the lack of comprehensive information relating to services infrastructure and evidence of appropriate consents, the Planning Authority is not satisfied that the proposed development would not negatively impact services infrastructure at this location or that the proposal would not be contrary to objective WM 11-8 (water supply) and objective WM 11-9 (wastewater disposal) of the Cork County Development Plan 2022. The Planning Authority is therefore not satisfied that proposed development would not be prejudicial to public health and contrary to the proper planning and sustainable development of the area.
