The proposed development would be prejudicial to public health because the excessive gradient and steep topography of the site render the terrain unsuitable for the safe installation and operation of an on-site wastewater treatment system. The proposal fails to demonstrate compliance with the minimum standards set out in the EPA Code of Practice: Domestic Waste Water Treatment Systems (Population Equivalent $5 10) (2021). The planning authority is, therefore, not satisfied that the development would not give rise to effluent breakout, hydraulic failure, and the subsequent creation of an environmental and public health hazard.

The proposed development comprises the construction of a dwelling within a housing scheme on the north eastern side of Charleville town. On the basis of the available information and given the lack of comprehensive information relating to services infrastructure and evidence of appropriate consents, the Planning Authority is not satisfied that the proposed development would not negatively impact services infrastructure at this location or that the proposal would not be contrary to objective WM 11-8 (water supply) and objective WM 11-9 (wastewater disposal) of the Cork County Development Plan 2022. The Planning Authority is therefore not satisfied that proposed development would not be prejudicial to public health and contrary to the proper planning and sustainable development of the area.
